Is Kratom Legal in West Virginia?

Kratom, derived from the plant Mitragyna speciosa, is legal to buy, sell, possess, and consume anywhere in West Virginia. The bigger news is that Governor Jim Justice signed SB985 into law on April 1, 2026. The bill, officially titled “Relating to registration and enforcement of kratom products,” created West Virginia’s Kratom Consumer Protection Act (KCPA) — a set of rules that now govern how kratom products are made, labeled, and sold in the state.

Before this law, kratom was legal but unregulated. Retailers could sell it without any labeling standards or quality checks. The KCPA changes that, putting West Virginia in step with other states that have adopted similar consumer-protection laws for kratom.

What the KCPA Requires

The law lays out four main requirements for anyone selling kratom in the state:

• Age checks. Retailers must confirm a buyer is at least 18 before selling kratom.
• Honest labeling. Products need labels showing their ingredients and alkaloid content, including levels of mitragynine and 7-hydroxymitragynine.
• No adulterated or synthetic kratom. Selling contaminated, altered, or synthetic versions of the product is banned outright.
• No marketing to minors. Advertising and sales pitches aimed at kids aren’t allowed.

Other Bills in the Pipeline

SB985 wasn’t the only kratom-related bill moving through the 2026 legislative session. A few others worth knowing about:

• SB534, also called the Kratom Consumer Protection Act, was sent to the Senate Judiciary Committee.
• HB4270 would give the Department of Agriculture authority to write rules for certain plant-based derivatives, including kratom. It’s sitting with the House Judiciary Committee.
• HB4459, another KCPA-related proposal, went to the House Health and Human Resources Committee.
• HB5100 would shift kratom and CBD regulation from the Department of Agriculture over to the Alcohol Beverage Control Administration.

None of these bills has moved past committee as of this update. If any of them advance, it will likely affect how kratom is regulated going forward — worth checking back on periodically.

The KCPA sets 18 as the minimum age to buy kratom in West Virginia. This applies whether you’re buying in a store or ordering online — retailers on both sides are expected to verify age before completing a sale, and the rule covers every form of kratom, from powder to capsules to extracts.

Sellers also have to meet the law’s labeling and product-safety standards. Retailers that skip age verification, sell unlabeled products, or offer synthetic kratom risk enforcement action under the law. As a buyer, the easiest way to check a product’s legitimacy is to look for third-party lab testing and a Certificate of Analysis (COA) — these confirm what’s actually in the product and at what concentration.

No city or county in West Virginia has passed its own kratom ban. The KCPA applies uniformly across the state, so the rules are the same whether you’re in Charleston, Morgantown, or anywhere else in West Virginia.

Smoke shops, herbal stores, and specialty retailers across the state carry kratom, and all of them are expected to follow the KCPA’s age-verification and labeling rules. If you’d rather shop online, look for a vendor that publishes third-party lab results and COAs for every batch — that’s the clearest way to confirm a product meets West Virginia’s standards.

Common product types include:

• Capsules — usually 600mg per capsule, pre-measured and easy to dose
• Powder — the standard form for brewing kratom tea
• Extracts — more concentrated, generally used by people already familiar with kratom

Ordering online is a legal option for West Virginia residents, and it often gives you access to a wider range of strains than a local shop would carry. When choosing an online vendor, prioritize ones that provide lab-tested products with available COAs and reasonable shipping times — that combination gives you the best assurance of what you’re actually getting.
