Is Kratom Legal in Washington State?

Kratom isn’t listed as a controlled substance under Washington’s Uniform Controlled Substances Act (RCW 69.50), and no city or county in the state has passed its own ban. That means kratom is legal statewide — from Seattle to Spokane and everywhere in between.

One quick clarification: Washington State and Washington, D.C. are two different places with two different legal systems. Kratom happens to be legal in both, but don’t confuse the two when researching laws.

Unlike some states, Washington hasn’t passed a Kratom Consumer Protection Act (KCPA). That means there’s currently no state law requiring kratom sellers to test their products, label them a certain way, or check ID before selling to a specific age group. Ordinary consumer protection and food safety rules still apply to any kratom sold in the state, but nothing kratom-specific exists yet.

That could change soon. Three bills are moving through the legislature right now.

Bills Currently Under Consideration

SB6287 would create consumer protection standards for kratom — think product safety rules and labeling requirements. It’s had a hearing in the Senate Ways & Means Committee.

HB2291 is the House’s version of the same idea: a formal Kratom Consumer Protection Act. It’s had a hearing in the House Committee on Consumer Protection & Business.

SB6196 takes a different approach — it would tax kratom products rather than regulate their safety. It’s sitting in the Ways & Means committee.

Worth keeping in mind: most bills introduced in any legislature never make it into law. The vast majority die in committee before ever getting a floor vote. So the fact that these three exist doesn’t mean any of them will pass. And even if they do, none would ban kratom — two are aimed at adding safety standards, and one is about taxation.

Federally, kratom isn’t scheduled under the Controlled Substances Act. The FDA hasn’t approved it for any medical use, but it also hasn’t taken steps to ban it nationally. Bottom line: kratom is legal to buy and possess under both federal law and Washington State law.

If you’re traveling around the region, Oregon and Alaska also allow kratom, so you can cross state lines in the Pacific Northwest without worrying about your kratom becoming illegal contraband.

There’s currently no state law setting a minimum age to buy kratom in Washington. In practice, most legitimate vendors — online and in stores — voluntarily require buyers to be at least 18. If SB6287 or HB2291 eventually becomes law, expect a formal age requirement to come with it, as that’s standard in most KCPA legislation. Neither bill has passed as of this writing.

Since Washington doesn’t yet require lab testing or specific labeling, it’s on the buyer to be selective. Look for vendors who publish third-party lab results and Certificates of Analysis voluntarily — it’s a good sign they’re serious about product quality even without a legal mandate.

Online is generally the better option for most buyers. Reputable online retailers tend to offer lab-tested products, a wider selection (powders, capsules, extracts, gummies), and prices that beat what you’ll typically find in a retail storefront. Shipping to Washington addresses is usually quick.

Local shops are also plentiful, especially around Seattle and the greater King County area. Smoke shops, herbal stores, and dedicated kratom retailers carry a range of products, and kratom has become a fairly normal fixture in the region’s wellness and herbal shop scene.

No city or county in Washington has banned kratom. It’s legal statewide, including in:

• Seattle — widely available, strong vendor presence
• Spokane — legal and sold in local shops
• Tacoma — no restrictions
• Vancouver, WA — legal, and just across the river from Portland, where it’s also legal
• Bellevue — carried by wellness shops
• Olympia — legal even in the state capital
• Everett — widely available

Kratom remains fully legal in Washington State, and there’s no indication that’s about to change. What might change is the level of regulation — testing standards, labeling rules, and possibly a minimum purchase age — if lawmakers pass one of the pending KCPA bills. For now, the safest approach for consumers is the same as in any unregulated market: buy from vendors who test their products and are transparent about it, even though the state doesn’t yet require them to.
