Is Kratom Legal in Utah? A Look at the State's Rules

Kratom — the botanical known scientifically as Mitragyna speciosa — is legal to buy, sell, possess, and consume in Utah. Neither of its main alkaloids, mitragynine and 7-hydroxymitragynine, is treated as a controlled substance under state law.

The Original Law: SB 58 (2019)

Utah’s Kratom Consumer Protection Act started as Senate Bill 58, signed in 2019. Rather than banning kratom, lawmakers chose to regulate it, building in several consumer safeguards:

• Age checks — Retailers must confirm a buyer is at least 18 before selling kratom.
• Labeling standards — Products need accurate labels showing ingredients and alkaloid levels, including mitragynine and 7-hydroxymitragynine content.
• No adulterated products — Selling contaminated kratom, or products with hidden additives or synthetic alkaloids, is against the law.
• No marketing to minors — Packaging and advertising can’t be designed to appeal to anyone under 18.
• 7-OH concentration limits — Products can’t exceed set thresholds for 7-hydroxymitragynine.

A 2026 Update: SB0045, “Kratom Adjustments”

In March 2026, Utah’s governor signed SB0045, a bill that amends and refines the original KCPA rather than replacing it. The bill was filed with the Lieutenant Governor’s office on March 26, 2026, and signed the following day.

As of this writing, the exact date the new provisions take effect hasn’t been published yet. Anyone buying or selling kratom in Utah should keep an eye on legislative trackers for that detail. What’s clear is that Utah continues to treat kratom as something to regulate carefully rather than prohibit outright — a stance that’s held since the original 2019 law.

There’s currently no other kratom-related legislation moving through the Utah legislature this session.

The purchase age is 18. Both physical stores and online retailers shipping into Utah are required to verify a buyer’s age before completing a sale — selling to anyone younger is a violation of state law.

Beyond age verification, sellers also have to make sure their products meet the KCPA’s labeling and purity rules. That means accurate alkaloid content on the label, a full ingredient list, and no synthetic or adulterated substances mixed in. No city or county in Utah has passed its own kratom ban. The Kratom Consumer Protection Act sets one statewide standard, and every local jurisdiction operates under it. So whether you’re in Salt Lake City, Provo, or a smaller town, the same rules apply.
