Is Kratom Legal in Texas?

Texas is one of a small number of states with a law written specifically for kratom. In 2023, lawmakers passed Health & Safety Code Chapter 444, which set up rules for how kratom products can be sold in the state. The law does three main things:

• It bans synthetic kratom alkaloids outright.
• It caps 7-hydroxymitragynine (7-OH) at 2% of a product’s total alkaloid content.
• It leaves natural, unadulterated kratom leaf and standard-strength products untouched and fully legal.

In short, Texas picked a middle path: crack down on synthetic and high-potency products while leaving ordinary kratom leaf alone for consumers who want it.

Kratom itself is not listed as a controlled substance under the Texas Controlled Substances Act, and no bill aimed at banning or heavily restricting the plant has gained real traction in the legislature.

A newer proposal, Senate Bill 1868, is currently sitting in the Public Health committee for the 2025-2026 session. If it passes, it would rename Chapter 444 as Chapter 445 and add several new pieces:

• Formal definitions for “kratom processor” and “kratom retailer”
• A requirement that products get tested by an accredited lab and carry proper labeling before they can be sold
• New criminal penalties for selling kratom that doesn’t meet these standards, along with higher civil fines

This bill isn’t trying to ban kratom — it’s aimed at tightening compliance for the businesses that sell it. The approach looks similar to the Kratom Consumer Protection Act (KCPA) that other states have adopted, though Texas hasn’t formally passed a KCPA of its own yet.

That’s an important distinction from states like Florida and Georgia, which already require lab testing, labeling, and age verification by law. In Texas, none of that is currently mandated — it’s up to individual vendors to test and label responsibly on their own.

Unlike California, where San Diego has restricted retail kratom sales, no Texas city or county has passed its own kratom ban or added extra restrictions. Kratom is sold openly in Houston, Dallas, San Antonio, Austin, and smaller towns across the state — there’s no patchwork of local rules to navigate.

Because of its size, Texas has one of the biggest kratom markets in the country. Smoke shops, specialty botanical stores, and some wellness retailers carry it in most major cities and plenty of smaller ones too.

Quality varies a lot between retail locations, though — especially at gas stations and convenience stores, which sometimes carry kratom but rarely test it. Buying from an online vendor that provides third-party lab results is usually the more reliable option if you care about purity and consistent potency. Look for a Certificate of Analysis (COA) on any product you’re considering; it should confirm the alkaloid content and rule out contamination.

Common product types available to Texas buyers include:

• Capsules (often pre-measured, around 600mg per capsule) for convenience
• Bulk powder for people who already know their preferred dose
• Extracts, which are more concentrated and generally suited to experienced users

There’s no legal barrier to ordering kratom online and having it shipped to a Texas address. Buying online often comes with a few practical advantages over walking into a shop: wider strain selection, verifiable lab testing on every batch, and frequently better pricing than what you’d find on a store shelf.

Not really. Texas already committed to a regulatory approach with Chapter 444 in 2023, and SB 1868 continues down that same road rather than reversing course. The American Kratom Association has pointed to Texas as one of the more stable states for continued kratom access, precisely because lawmakers chose regulation over prohibition.

If you’re new to kratom, it helps to start slow and pay attention to how you respond. Capsules tend to be the simplest way to try it since the dosing is already measured out for you. Sample packs of different strains can also be a low-cost way to figure out what you prefer before buying in bulk.

Kratom remains legal across Texas, with the state opting to regulate rather than ban it. The 2023 law addressing synthetic alkaloids and 7-OH content, plus the pending SB 1868, suggest lawmakers are focused on tightening safety standards rather than closing off access. As with any product in this space, checking lab results and buying from a vendor that tests its products is the most reliable way to know what you’re getting.
