Is Kratom Legal in North Dakota?

North Dakota banned kratom (Mitragyna speciosa) through executive action in August 2026. Until then, the state had no kratom statute, no Kratom Consumer Protection Act (KCPA), and no age limit — products were sold in smoke shops and convenience stores with almost no rules. That changed on August 3, 2026, when Gov. Kelly Armstrong and Attorney General Drew Wrigley announced emergency measures. Armstrong issued an executive order declaring a public health emergency and prohibiting the sale, use, and possession of all kratom and kratom products, effective 5 p.m. on August 5, 2026. The same week, the North Dakota Board of Pharmacy issued an emergency rule — signed by the governor — classifying 7-hydroxymitragynine (7-OH) as a Schedule I controlled substance, the same class as heroin and LSD. That pharmacy rule lasts 180 days unless the legislature replaces it. The ban is not limited to extracts or synthetics. It covers leaf, powder, capsules, gummies, shots, and 7-OH products. There is no personal-use carve-out. Armstrong also called a special legislative session for September 2, 2026, to write the prohibition into state law, set enforcement authority, and address 7-OH scheduling. Until that session (or a later statute) replaces the emergency order, the statewide ban is already in effect. Federally, natural leaf kratom remains unscheduled. The DEA has moved to temporarily schedule concentrated 7-OH above a set threshold — a separate federal action that does not legalize kratom in North Dakota. Under the emergency order, violating the statewide prohibition is an infraction with a fine of up to $1,000. Retailers were told to pull products off shelves; unused inventory can be turned in to law enforcement or MedSafe pharmacy drop sites. The 7-OH Schedule I emergency rule is stricter. Handling 7-OH as a Schedule I substance can trigger controlled-substance penalties beyond the $1,000 infraction — the legislature is expected to clarify that in September. This is not a paper ban. The governor's office tied the order to overdose deaths associated with kratom in the state and to the lack of age limits or testing before August 2026. Anyone driving through North Dakota should treat kratom the same way they would in other banned states: even a small amount can get you stopped. The special session may raise penalties. Check current statute after September 2, 2026, rather than assuming the $1,000 infraction is the final word.

Kratom sales are not permitted in North Dakota. Legitimate vendors should not ship into the state. Buying it in a legal neighboring state and bringing it back still violates the possession ban. Local smoke shops and travel plazas were instructed to clear shelves when the order took effect. The MHA Nation also announced a separate ban on tribal land beginning August 12, 2026.  

The emergency order is temporary by design. The September 2, 2026 special session is meant to make the ban permanent, lock in 7-OH Schedule I status, and define enforcement. No KCPA-style regulatory bill is on the table in this round. North Dakota is moving from “unregulated legal” to “banned,” not to labeled, age-gated sales. Bans can be reversed — Rhode Island did that in 2025 — but that is not the current direction here. Watch the special session and any bill that follows it.
