Is Kratom Legal in Massachusetts?

As of this writing, Massachusetts has no law on the books that bans, limits, or specifically regulates kratom. This bill has already cleared committee with a favorable report and moved on to House Ways and Means. If it passes, expect rules around labeling, product testing, and a minimum age for purchase. These two bills are essentially competing bets on how Massachusetts should handle kratom going forward. It’s worth checking back periodically, since either one could move quickly once committee work wraps up. On the federal side, kratom isn’t a controlled substance. The FDA hasn’t approved it for medical use, but it also hasn’t scheduled it as a controlled drug. The DEA floated the idea of scheduling kratom back in 2016, then backed off after public pushback.

There’s no state-mandated minimum age for buying kratom in Massachusetts right now. Since no law addresses it, there’s technically nothing stopping a retailer from selling to anyone.
