Is Kratom Legal in Georgia?

A Bill Worth Watching: HB968

There’s a bill moving through the Georgia legislature that could undo all of this. HB968, introduced during the 2025–2026 session, would reclassify mitragynine and 7-hydroxymitragynine as Schedule I controlled substances — effectively banning kratom statewide and wiping out the KCPA.

As of early March 2026, the bill had been favorably reported by substitute out of a House committee. That’s progress, but it still needs to clear both chambers and get signed before it becomes law. The purchase age under the KCPA is 18. That applies whether you’re walking into a shop or ordering from an online retailer that ships to Georgia — sellers are required to verify age before completing the sale. Selling to anyone younger is a violation of state law.
